Terms and Conditions

1. Introduction

Welcome to 3jbni, an application developed to help users discover and share Kuwaiti restaurant’s top dishes, drinks, and desserts. By downloading, accessing, or using the 3jbni application (the “App”), you agree to comply with and be bound by the following terms and conditions (the “Terms”). Please review these Terms carefully. If you do not agree to these Terms, you should not use the App.

2. Use of the App

  • Eligibility: You must be at least 13 years old to use this App. If you are under 18, you must have the consent of your parent or legal guardian to use the App.
  • Prohibited Activities: You agree not to:
    • Use the App for any illegal or unauthorized purpose.
    • Modify, adapt, hack, or reverse engineer the App.
    • Use the App to transmit any worms, viruses, or any code of a destructive nature.
    • Violate any local laws in your jurisdiction.

3. User Content

  • Content Ownership: By submitting any content (including photos, reviews, and other materials) to the App, you grant 3jbni a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of operating the App.
  • Responsibility: You are solely responsible for the content you submit. You must ensure that you have the necessary rights to submit such content and that it does not infringe on the rights of any third party.

4. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which can be found in our official website. By using the App, you agree to the collection, use, and sharing of your information as described in our Privacy Policy.

5. Reviews and Ratings

  • Accuracy: You agree to provide accurate and truthful reviews and ratings. Misleading or false reviews will be removed.
  • Public Content: Reviews and ratings you submit may be publicly displayed. You can choose to make your photos public or keep them private.
  • Removal of Reviews: The 3jbni team reserves the right to remove any reviews or ratings submitted by users for any reason, including but not limited to inaccuracies, changes in restaurant menus, or any other reason deemed appropriate by the 3jbni team.
  • Menu Accuracy Disclaimer: Reviews and ratings are approved based on the accuracy of the restaurant’s menu at the specific date of submission. Over time, menu items and their quality may change, and such reviews may become inaccurate. 3jbni is not responsible for updating these inaccuracies unless the changes are brought to our attention.
  • Review Limitation: Users may only submit up to two reviews per item per week. This limitation is in place to prevent the submission of fake or paid reviews.

6. Intellectual Property

  • Ownership: All intellectual property rights in the App and its content (excluding user-generated content) are owned by 3jbni.
  • Restrictions: You may not reproduce, distribute, or create derivative works from the App or its content without express written permission from 3jbni.
  • Prohibited Use of Trade Name: It is prohibited to use the application name “3jbni” in any private or public publications without prior written consent from the administration. Unauthorized use shall be deemed a breach of the trade name and exploitation of the trademark and commercial address. Violators shall be subject to criminal and civil liability and legal repercussions.

7. Limitation of Liability

  • Limitation: In no event shall 3jbni be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the App.

8. Termination

3jbni reserves the right to terminate or suspend your access to the App at any time, without notice and for any reason, including, but not limited to, breach of these Terms.

9. Changes to the Terms

3jbni may modify these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms in the App. Your continued use of the App following the posting of changes constitutes your acceptance of such changes.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kuwait.

11. Offensive Language and Conduct

  • Prohibited Conduct: Users must not use offensive, obscene, or abusive language in any content submitted to the App. Any such conduct is strictly prohibited.
  • Legal Action: If users violate these terms by using offensive language or engaging in prohibited conduct, the 3jbni team reserves the right to pursue legal action. This may include using the information attached to the offending user’s profile to initiate legal proceedings.

12. Authenticity and Integrity of Reviews

  • User-Submitted Reviews: All reviews in the App are submitted by real people. The 3jbni team has no involvement in determining which restaurants receive the most votes.
  • Data Handling: The 3jbni team only adds information related to the number of votes for dishes, drinks, and desserts to the App and approving the images submitted by users.
  • No Manipulation or Endorsement: There is no manipulation or use of ads to endorse any items in the leaderboard pages of the App. The rankings reflect genuine user feedback without any external influence.

13. Registration and Account

  • Electronic Acceptance: Registration for the App is electronically accepted according to the programming for which it is prepared, without any human intervention.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify 3jbni immediately of any unauthorized use of your account.

14. Communication with Users

By registering for the App, you agree that the phone numbers and email addresses provided during the registration process may be used by 3jbni to communicate with you. This includes reaching out to you with news, giveaways, offers, deals, and promo codes.

وصف التطبيق

برنامج يقوم بتقييم افضل الاكلات و الحلويات و المشروبات الموجودة في مطاعم دولة الكويت, المستخدمين يقومون بالتسجيل في البرنامج بادخال الاسم و رقم الهاتف و الايميل و رقم سري. المستخدم يتفعل حسابه بعد ادخال كود يتم ارساله على رقم الهاتف.

طريقة الاستخدام 

المستخدم يدخل قسم الاكلات او الحلويات او المشروبات و يضيف صورة للصنف الذي اعجب به  و يكتب فقط اسم الاكله و اسم المطعم و يرسل الطلب، يستلم الطلب فريق البرنامج الذي يتحكم بالبرنامج واذا لم تتحقق شروط التحقق لايتم اعتماد الطلب من قبل فريق العمل.

  • المستخدمين لهم القدرة على اضافة الاصناف وتحويلها الى صفحة اسمها (يستاهل تجربه) الصفحة هذه فيها كل الاكلات و المشروبات و الحلويات التي كان المستخدم اختارها عن طريق زر اسمه (للتجربه)  حتى يحتفظ بها ويقوم بتجربة الصنف الذي قام باعجاب مستخدم اخر.
  • المستخدمين لهم القدرة باضافة تقييمين لكل صنف بالاسبوع لتفادي التقييمات المتكررة من مستخدم واحد، وفي حال محاولة لإضافة أكثر من تقييمين سوف يتم ارسال رسالة ان الطلب مرفوض. 

صلاحيات فريق العمل و المحضورات

فريق البرنامج له صلاحية حذف اي مستخدم قام باي عمل مسيء للبرنامج او عمل مسيء لفريق البرنامج مع أحقية فريق البرنامج بإتخاذ كافة الإجراءات القانونية.

فريق البرنامج له الصلاحية ان يمسح اي تقييم لاي صنف اذا الصنف لم يعد متواجد في منيو المطعم او لاي سبب اخر.

التأكد من صحة البيانات التي تم ادخالها من قبل المستخدمين.
